{"id":1817,"date":"2023-07-04T12:52:04","date_gmt":"2023-07-04T12:52:04","guid":{"rendered":"https:\/\/pragal-prinzenberg.de\/global-defence-alliance-2\/"},"modified":"2025-05-28T08:14:29","modified_gmt":"2025-05-28T08:14:29","slug":"cross-border-defence","status":"publish","type":"page","link":"https:\/\/pragal-rechtsanwaelte.de\/en\/competencies\/criminal-defence\/cross-border-defence\/","title":{"rendered":"\u201cCross-Border\u201d Defence"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">INTERNATIONAL CRIMINAL PROCEEDINGS AND CROSS-BORDER INVESTIGATIONS<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In recent years, the number of criminal investigations with cross-border implications (\u201ccross-border investigations\u201d) has increased considerably.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This development is mainly due to increased cooperation in the context of international criminal law, in particular in the prosecution of economic and financial crime by national and international law enforcement authorities, such as <a href=\"https:\/\/anti-fraud.ec.europa.eu\/index_de\" target=\"_blank\" rel=\"noreferrer noopener\">OLAF<\/a> and the <a href=\"https:\/\/www.eppo.europa.eu\/en\" target=\"_blank\" rel=\"noreferrer noopener\">European Public Prosecutor&#8217;s Office (\u201cEPPO\u201d), EUROPOL and INTERPOL<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Our firm has extensive experience in defending clients (<a href=\"https:\/\/pragal-rechtsanwaelte.de\/en\/competencies\/criminal-defence\/individual-defence\/\">individual<\/a> and <a href=\"https:\/\/pragal-rechtsanwaelte.de\/en\/competencies\/criminal-defence\/corporate-defence\/\">corporate defence<\/a>) who are confronted with such international proceedings.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">DEFENcE AGAINST EXTRADITION REQUESTS AND INTERNATIONAL ARREST WARRANTS<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We represent both individuals and companies in a wide range of cross-border <a href=\"https:\/\/pragal-rechtsanwaelte.de\/en\/competencies\/criminal-defence\/\">criminal matters<\/a>. A frequent area of our practice is the defence against extradition requests as well as the defence against <a href=\"https:\/\/commission.europa.eu\/law\/cross-border-cases\/judicial-cooperation\/types-judicial-cooperation\/european-arrest-warrant_en\" target=\"_blank\" rel=\"noreferrer noopener\">European Arrest Warrants (EAW<\/a>) and international arrest warrants, in particular so-called <a href=\"https:\/\/www.interpol.int\/How-we-work\/Notices\/Red-Notices\/View-Red-Notices\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cRed Notices\u201d issued by INTERPOL<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition, we support our clients with <a href=\"https:\/\/e-justice.europa.eu\/92\/DE\/european_investigation_order_mutual_legal_assistance_and_joint_investigation_teams\" target=\"_blank\" rel=\"noreferrer noopener\">European Investigation Orders<\/a>, which enable evidence to be gathered across borders. A <strong>European Investigation Order<\/strong> is a judicial or administrative order issued or confirmed by a judicial authority of an EU member state to carry out investigative measures in another EU country to gather evidence in criminal proceedings.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">PROTECTION AGAINST DOUBLE JEOPARDY IN INTERNATIONAL CRIMINAL LAW<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A further and increasingly important focus is the enforcement of the prohibition of double jeopardy (\u201cne bis in idem\u201d principle), which ensures that a person is not tried or punished more than once for the same offense. This aspect is of particular importance in cross-border investigations against companies, as shown by the <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/DE\/ALL\/?uri=CELEX:62022CJ0027\" target=\"_blank\" rel=\"noreferrer noopener\">decision of the European Court of Justice (ECJ) of 14 September 2023 in Case C-27\/22 <\/a>in favor of Volkswagen (VW) in connection with the &#8220;ne bis in idem&#8221; principle. In this decision, the ECJ stated that the principle of \u201cne bis in idem\u201d also applies to sanctions that can be classified as administrative sanctions of a criminal nature.
