There are daily reports in the media about legal violations and the treatment of the companies concerned is often harsh. Public opinion has also changed. Violations of the law and regulations in companies are no longer perceived as \u201ctrivial offenses\u201d, but are met with public disapproval.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Companies are therefore well advised to react quickly and correctly once they become aware of a compliance breach.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Engelhoven\/Pragal, in: \u201c<a href=\"https:\/\/www.beck-shop.de\/engelhoven-richtiges-verhalten-compliance-krise\/product\/34039837?gad_source=1&amp;gclid=Cj0KCQiA_NC9BhCkARIsABSnSTa7RgbXoNwqhov56ebi2r-M8_6ihMmDJe5H1p9z7AbXmeWYmihBJc8aAqbVEALw_wcB\" target=\"_blank\" rel=\"noreferrer noopener\">Richtiges Verhalten in der Compliance-Krise<\/a>\u201c [\u201cCorrect Behavior in a Compliance Crisis\u201d] (1st edition., ed.: <a href=\"https:\/\/www.esche.de\/persoenlichkeiten\/philipp-engelhoven\" target=\"_blank\" rel=\"noreferrer noopener\">Philipp Engelhoven<\/a>) \u00a7 1 Rn.1.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In today&#8217;s business world, <strong>compliance crises<\/strong> pose a serious threat to companies.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Legal consequences and reputational risks of compliance violations<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This results firstly from the threat of company fines pursuant to <a href=\"https:\/\/www.gesetze-im-internet.de\/owig_1968\/__30.html\" target=\"_blank\" rel=\"noreferrer noopener\">Section 30 OWiG<\/a>, the confiscation of assets (\u201casset confiscation\u201d) pursuant to <a href=\"https:\/\/www.gesetze-im-internet.de\/stgb\/__73.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 73 et seq. of the German Criminal Code <\/a>(StGB) and, last but not least, reputational damage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Furthermore, since December 1, 2021, authorities such as public prosecutors, custom authorities, tax offices and antitrust authorities, have been obliged to notify the <a href=\"https:\/\/www.bundeskartellamt.de\/DE\/Aufgaben\/Wettbewerbsregister\/Wettbewerbsregister\/wettbewerbsregister_node.html\" target=\"_blank\" rel=\"noreferrer noopener\">competition register<\/a> maintained by the Federal Cartel Office of relevant violations of the law (see <a href=\"https:\/\/www.gesetze-im-internet.de\/wregg\/__4.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 4 (1) WRegG<\/a>). Since June 1, 2022, public contracting authorities have been obliged to consult the competition register in procurement procedures with an estimated contract value of EUR 30,000 or more (excluding VAT) (see <a href=\"https:\/\/www.gesetze-im-internet.de\/wregg\/__6.html\">\u00a7 6 (1) sentence 1 WRegG<\/a>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are also numerous \u201canti-corruption registers\u201d at state level. In Hamburg and Schleswig-Holstein, for example, the \u201cAdministrative Agreement on the Establishment of the Joint Register for the Protection of Fair Competition (Corruption Register)\u201d was signed between the two states on 13.01.2014 and a joint register was set up.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All contracting authorities within the meaning of Section 2 of the Hamburg Public Procurement Act (<a href=\"https:\/\/www.landesrecht-hamburg.de\/bsha\/document\/jlr-VergabeGHA2006rahmen\" target=\"_blank\" rel=\"noreferrer noopener\">HmbVgG<\/a>) and recipients of grants from the Free and Hanseatic City of Hamburg who are obliged to apply public procurement law when awarding contracts must use the register.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Internal Review and crisis management for damage Control<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/pragal-rechtsanwaelte.de\/en\/competencies\/compliance\/\">Compliance<\/a> violations can therefore easily spread into a \u201cwildfire\u201d within the company and also damage relationships with employees, customers and shareholders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In order to avoid serious consequences, it is essential for companies to react <strong>quickly and appropriately<\/strong> to a compliance breach.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A <strong>comprehensive internal review<\/strong> of the incident is required in order to create transparency and take appropriate measures to limit the damage.
