{"id":1890,"date":"2023-11-20T15:41:35","date_gmt":"2023-11-20T15:41:35","guid":{"rendered":"https:\/\/pragal-prinzenberg.de\/2023\/11\/20\/zufuehrung-von-patienten-an-einen-hersteller-von-nahrungsergaenzungsmitteln-nem-durch-aerzte-aus-rechtsgruenden-nicht-den-tatbestand-der-%c2%a7%c2%a7-299a-b-stgb-lg-hildesheim\/"},"modified":"2025-02-18T10:44:10","modified_gmt":"2025-02-18T10:44:10","slug":"recommendation-dietary-supplements-not-punishable-299-a-b-stgb","status":"publish","type":"post","link":"https:\/\/pragal-rechtsanwaelte.de\/en\/blog\/recommendation-dietary-supplements-not-punishable-299-a-b-stgb\/","title":{"rendered":"Medical recommendation of dietary supplements not punishable under \u00a7 299a\/b StGB (Hildesheim Regional Court)"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">In an as yet unpublished appeal decision from 7 February 2020 (decision Hildesheim Regional Court 15 Qs 1\/20), the Hildesheim Regional Court has ruled that the referral of patients to a manufacturer of dietary supplements by doctors does not qualify as an offence in accordance with \u00a7\u00a7 299a\/b StGB.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is because the \u201creferral\u201d must always commence in favor of an authorized service provider in accordance with \u00a7 299b (3) StGB. These, however, are only those legal entities or persons who are authorized by health insurance providers, who offer services and bill the providers for these services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, in the case of producers of dietary supplements, this merely constituted the \u201creferral\u201d of mere \u201ccustomers\u201d rather than patients (see our <a href=\"https:\/\/pragal-rechtsanwaelte.de\/en\/blog\/risks-distribution-dietary-supplements-via-licensed-panel-physicians\/\">blog entry from 5 February 2020<\/a>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Regional Court went on to state that the protected interest of \u00a7\u00a7 299a\/b StGB \u2013 e.g., trust in the integrity of a healthcare professional\u2019s decision and the regulatory mechanism structured by competition law \u2013 was not affected in the case in question. This is because the legislator only considered the \u201chealthcare professional-patient relationship\u201d to be worthy of special protection, which is usually departed if neither medicines, aids or medical products are involved, nor services are provided that are billable to the health insurance providers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, it should be emphasized that, naturally, the decision merely concerns the <a href=\"https:\/\/pragal-rechtsanwaelte.de\/en\/competencies\/criminal-defence\/\">criminal law related aspects<\/a> of the practiced business model.
