{"id":4144,"date":"2025-04-09T09:57:47","date_gmt":"2025-04-09T09:57:47","guid":{"rendered":"https:\/\/pragal-prinzenberg.de\/?p=4144"},"modified":"2025-06-05T07:30:21","modified_gmt":"2025-06-05T07:30:21","slug":"hamburg-court-no-main-hearing-beaching-case","status":"publish","type":"post","link":"https:\/\/pragal-rechtsanwaelte.de\/en\/blog\/hamburg-court-no-main-hearing-beaching-case\/","title":{"rendered":"Hamburg Regional Court: No Main Hearing in &#8220;Beaching&#8221; Case"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Legal Clarification on Transboundary Waste Shipments<\/h2>\n\n\n\n<p>In a decision dated March 31, 2025 (Case No.: 636 KLs 9\/23), the Hamburg Regional Court declined to open a main trial in an environmental criminal case. At the heart of the matter is the practice of so-called beaching \u2014 the disposal of old cargo ships on beaches, particularly in South Asian countries. There, ships are dismantled and recycled under often questionable conditions, regularly raising environmental and <a href=\"https:\/\/pragal-rechtsanwaelte.de\/en\/competencies\/criminal-defence\/\">criminal law concerns<\/a>. We had previously reported on the investigation <a href=\"https:\/\/pragal-rechtsanwaelte.de\/en\/blog\/cessation-investigations-alleged-illegal-ship-scrapping-beaching\/\">in an earlier blog post<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>The Underlying Facts<\/strong><\/h3>\n\n\n\n<p>The investigation targeted several defendants accused of being involved in the sale of a container ship that was ultimately sent to Asia for scrapping. The indictment was based on <a href=\"https:\/\/www.gesetze-im-internet.de\/abfverbrg_2007\/__18a.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 18a AbfVerbrG<\/a> (German Waste Shipment Act), which criminalizes the illegal shipment of hazardous waste.<\/p>\n\n\n\n<p>However, in the view of the Hamburg criminal chamber, this offense does not apply in the present case. While the process could be classified as a transboundary waste shipment under <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/HTML\/?uri=CELEX:32006R1013\" target=\"_blank\" rel=\"noreferrer noopener\">EU Regulation 1013\/2006<\/a>, the application of the German Waste Shipment Act requires that an actual export from German territory has taken place \u2014 a condition not met here. Conduct originating from Germany, such as contractual control, is insufficient for criminal liability.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Implications for Criminal Practice<\/h2>\n\n\n\n<p>The decision highlights the importance of territorial limitations in environmental criminal law. Especially <a href=\"https:\/\/pragal-rechtsanwaelte.de\/en\/competencies\/criminal-defence\/cross-border-defence\/\">in international cases<\/a>, a precise examination of the scope of application is essential. The ruling thus points to the limits of German criminal jurisdiction in foreign matters and is likely to have a signaling effect in similar cases \u2014 particularly regarding investigations currently being pursued by the Hamburg public prosecutor\u2019s office.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Between National Jurisdiction and International Responsibility<\/h2>\n\n\n\n<p>The legal relevance of the decision extends beyond national borders. The balance between international corporate responsibility and national criminal liability in foreign matters is a topic increasingly discussed in international legal circles.<\/p>\n\n\n\n<p>I will address this and similar ESG cases at the <a href=\"https:\/\/www.ibanet.org\/conference-details\/CONF2625\" target=\"_blank\" rel=\"noreferrer noopener\">27th Annual Transnational Crime Conference of the International Bar Association (IBA)<\/a> in Santiago de Chile.
