Pragal Rechtsanwälte and SCHOMERUS launch webinar series “Law & Risk” – Episode 1: Compliance violations by employees

Together with the law firm SCHOMERUS starts Pragal Attorneys at Law is launching the new “Law & Risk” webinar series in April . In short online events, the speakers will address typical problem constellations in which employment law and criminal law issues converge in the company, such as compliance violations, internal investigations or management liability issues.

The event will kick off with a webinar on “Compliance violations by employees – consequences under employment law and criminal law“.

Compliance issues regularly raise complex questions in practice. Companies must clarify possible breaches of duty, examine measures under employment law and at the same time consider criminal law risks. This raises the following questions: What are employers’ obligations to investigate? When can dismissals be considered? Under what circumstances is it sensible or even necessary to press charges and when can this prove to be detrimental? And how can the necessary balance be struck between the duty of care towards employees and the protection of the company, particularly with regard to the duty to cooperate in internal investigations and the prohibition on self-incrimination?

These and similar topics will be addressed in the first webinar and put into practice.

Contents of the first event

Among other things, the kick-off event will focus on:

  • Obligations and potential liability risks for employers in the event of compliance violations
  • Options for responding under labor law, in particular dismissals
  • Requirements and risks of a criminal complaint by the employer and options for the return of illegally obtained assets
  • the balance between the duty of care towards employees and the protection of the company
  • Employees’ obligations to cooperate in internal investigations and their limits due to the prohibition of self-incrimination

The webinar provides a structured overview of the legal framework and shows where there may be a need for organizational or legal action in practice.
